This study begins from the assumption that Foreign Direct Investment {FDI)l is important for the development of any country and more so for a developing country like Kenya. Based on the foregoing assumption, the study seeks to examine the law as one of the various factors that influences the flow of FDI into any country and the extent to which the prevailing legal regime of a country would influence the choice of a potential investor. This obtains from the hypothesis that the legal regime is one of the major determinants of the suitability of a business environment in any given jurisdiction. On that basis, the study will proceed to examine from the standpoint of a prospective foreign investor, the various pieces of legislation in Kenya that have a bearing on FDI. We will find out the extent to which the same favor entry into Kenya for the purposes of conducting business therein and support the business once its establlshed. Towards that end, an evaluation of the relevant laws in this regard shall be undertaken with a view to assessing their strengths and weaknesses if any.1 Foreign Direct Investment (FDI) is defined as 'investment made to acquire lasting interest in enterprises operating outside of the economy of the investor.' It is investment of foreign assets into domestic structures, equipment and organizations. The FDI relationship consists of a parent enterprise control over its foreign affiliate. http://n.wikipedia.org/wiki/Foreign direct investment visited on 15.06.07 The study will then conclude by making specific recommendations to be effected in or within the legal regime governing the business activities in Kenya with a view to making Kenya a more competitive business destination for FDI.en_US
