This paper analysese the legal aspects of the democratisation debate in Kenya in the context of the 1997 general elections, and explores the process of legal, constitutional and political reform, the conflicts that precipitated these reforms, and new conflicts to which the reforms gave rise. The paper concludes that the legal and constitutional regime is suitable where it helps to redress political conflicts in society and precludes the emergence of new ones.en
