Assessing the Eac Common Market Protocol: an Analysis of Kenya’s Implementation of Free Movement of Labour
Abstract
This study examined Kenya’s implementation of free labour movement. The main
objective of this study was to assess Kenya’s implementation of the EA Community
Common Market Protocol (EAC CMP). The specific objectives were to the current
implementation status of free movement of labour (FML) in Kenya as outlined under the
EAC CMP; to determine how Kenya’s infrastructural development influences the
implementation of free labour movement as outlined in the CMP in Kenya and to
determine how efforts to bridge social-cultural barriers influence the implementation of
free labour movement as outlined in the CMP in Kenya. The study employed qualitative
approach and sought to cover the exploratory and descriptive elements of the research
process. The first part of the study gives a background of EAC Protocol and free labour
movement. The second part provides details FML in East Africa, it synthesizes the
detailed aspects of free labour movement. In the third part, the paper delves in the
analysis of Kenya’s implementation of free labour movement. Lastly, the fourth part of
the paper presents a critical analysis of the study giving the contribution the study makes
to the general body of knowledge. The findings of the study reveal that while the
implementation of free labour movement in Kenya is on course, PSs (PSs) self-interest
pose a threat to the full implementation of the CMP. It was also revealed that sociocultural
factors contribute significantly to the implementation of free labour movement in
Kenya. The study recommends that there is need to establish well-delineated preference
for workers from PSs by either doing away with the work permit (WP) regime or making
the process of obtaining one simpler and by introduction of professional associations that
would initiate the creation of regional mechanisms for mutual recognition of professional
qualifications.
