A Comparative Analysis of Court-annexed Mediation in Kenya and Nigeria
Abstract
The objective of the study was to evaluate the effectiveness of existing legal and institutional
framework governing court-annexed mediation in Kenya. Specifically, the research
examined challenges Kenya court-annexed mediation face and made recommendations on
appropriate mechanisms to be adopted. This study adopted descriptive and analytical modes
of research. The research heavily relied on books, journals, statutes and cases.
The research explored a comparative analysis of Nigeria Multi-door courthouse and made
recommendations on mechanisms to be borrowed in order to ensure institutionalization of
mediation in Kenya judiciary achieve desired result of access to justice.
