| dc.description.abstract | The municipal council of Nakuru is a creation of the Local Government Act (cap 265). Like all other municipalities, the act provides for the establishment of local authorities. It also clearly defines their composition, roles function and jurisdiction. The Municipal council of Nakuru has a legislative arm, the major function of which is policy formulation, and an executive arm, which implements these policies. The council is supposed to manage the growth of the town by undertaking elaborate planning and managerial activities such as provision and delivery of services and control regulation of day to day development activities.
The implementation of planning policies and strategic structure plan for a sustainable urban development of Nakuru town and its environs has been wanting. It is therefore in this light the study endeavored to establish the extent to which the municipal council of Nakuru was implementing the rules and policies set out in the building codes and by laws. The purpose of the study was to evaluate the factors influencing the implementation of the current building codes and by laws and its effects in Nakuru Municipality.
The study was carried out within Nakuru Municipality among members of staff within the Department of Planning of Municipal Council of Nakuru and residential and commercial house owners within the Nakuru Central Business District. The study was guided by the following objectives: This study established the extent to which the municipal council of Nakuru was implementing the various provisions of the building codes and by laws; established the level of public awareness about the building codes and by laws with the municipal council of Nakuru; examined challenges facing the municipal council in implementing the building codes and by laws; and established the relevance and adherence of the planning policies both environmental and structural as far as building and construction is concern. A Descriptive survey research design was adapted and purposive sampling technique used in the selection of 100 building owners, 50 MCN employees and 30 contractors.
Data was collected by use of questionnaires, and analyzed for Descriptive statistics (frequencies and percentages) and Chi Square tests with the aid of Statistical Package for Social Sciences software. The results were presented using tables. The study findings showed that The Municipal Council of Nakuru was implementing the various provisions of the building codes and by laws to a large extent; and The level of public awareness about the building codes and by laws with the municipal council of Nakuru was above average.
According to the findings, the challenges facing the municipal council in implementing the building codes and by laws included corruption; lack of vehicles to visit sites; high ignorance among members of the public; and political interference. It was also found that in the Municipal Council of Nakuru, relevance and adherence of the planning policies
both environmental and structural as far as building and construction was concerned were not fully adhered to.
Following these findings the study recommended that the Government of Kenya and Concerned stakeholders to consider mobilizing resources to scale up awareness campaigns to members of the public to enhance awareness of Building codes and By laws; and to consider through established structures and regulation formulation geared at curbing political interference is tamed. These findings may be useful to all concerned stakeholders in the development of strategies geared towards effective implementation of the Building codes and By laws. | en_US |
